PERSONAL DATA OF PERSONS UNDER 16
We do not intend to process personal data of persons under the age of 16. However, we cannot verify that a visitor to our websites and servers is over 16 years old. If we collect information from persons under the age of 16, this will always be done with the consent of their parent or guardian.

TRANSFER TO PARTNERS
We work with different suppliers and partners to deliver our services. These suppliers & partners include parties that:
– Provide our platform and forum (Funnelbox)
– How’s handle our payments & collections (Jorrt & Mollie)
– Hosting our web hosting (InterIp)
– Taking care of our accounts (Jorrt & Welcome to BAS)
– Who else do you work with? (Editoo & Petra Haarmans)

We have concluded processing agreements and/or confidentiality agreements with sub-processors to ensure the security of your data. We only work with partners who can comply with AVG legislation. Some of our partners are located outside the European Economic Area (the countries within the European Union, Liechtenstein, Norway and Iceland). Your data can be processed in America and/or other countries where these companies have their cloud storage and servers and/or backups. With these partners we have taken appropriate measures which have been agreed by contract through a processing agreement / Data Processing Addendum or by means of a model agreement of the European Commission (click here). The more stringent GDPR (the AVG) is often signed and operated by most of them. In this way, we ensure that your data is well protected.

TRANSFER TO THIRD PARTIES
In principle, we do not share or sell your data with anyone or organizations outside of Worldwide Heart Resorts, except with partners as described above. We may also be required to provide your information on the basis of a legal obligation.

THE SECURITY OF YOUR DATA
Worldwide Heart Resorts has taken appropriate technical and organizational security measures to protect your personal data from misuse, unlawful or unauthorized.

USE AND LOSS
All parties that process your data for us (sub-processors) or can see in (think of employees or rental agents) sign a processing agreement or confidentiality agreement.

HOW LONG ARE YOUR DATA STORED?
We have different retention periods for different data flows. Of course, you always have the right to ask us to delete your data. See also the heading “your Rights”.
-Personal data such as name, address, telephone number and e-mail are deleted 5 years after our last contact.
-E-mail older than 1 years will be deleted unless it is still relevant for the execution of an agreement or resolution of a dispute.
Invoices and quotations are deleted after the statutory retention period of 7 years. Your data will remain in our billing system until then.

YOUR RIGHTS
You have the right to view, correct and delete your personal information. In addition, you have the right to withdraw your consent for data processing or to object to the processing of your personal data by Worldwide Heart Resorts. You also have the right to data portability. You can send a request for review, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to contact@worldwideheartresorts.com.
To ensure that the request for review has been made by you, please enclose a copy of your ID with the request. In this copy, make your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and social security number (SSN) black. This is to protect your privacy.
If your request relates to a cookie, we ask you to send it. We will respond to your request as soon as possible, but no later than four weeks.

Worldwide Heart Resorts would also like to point out that you have the possibility to file a complaint with the National Supervisor, the Personal Data Authority.

REPORTING A DATA RACK
If, despite all the precautions, a data pitch is still taking place, we will comply with the reporting obligation of data leakage and, if necessary, we will report this leak to the Authority within 72 hours of the detection of personal data. If you discover a datalek, we kindly ask you to share this with us as soon as possible but at least within 24 hours after you have found the leak by sending an e-mail to contact@worldwideheartresorts.com. We can then take immediate action.

LIABILITY
This privacy statement relates only to personal data processed by Worldwide Heart Resorts for the purposes of the items discussed in this Agreement. Worldwide Heart Resorts accepts no responsibility or liability for (the operation and/or content of) third party websites or services.

AMENDMENTS TO THIS STATEMENT
The content of this privacy statement may be updated at any time by Worldwide Heart Resorts to respond to new developments in the field of laws, regulations or changes within our company. You can subscribe to our newsletter and we will keep you informed of any changes.
In any event, we recommend that you periodically review this privacy statement to be informed of our privacy policy. By continuing to use the Worldwide Heart Resorts services after changes, you agree to these changes.
